Terms of service
1. The service
OtsoVision is a cloud service for receiving, storing, classifying and analysing images from trail cameras. The service includes AI-based species detection, weather-aware activity forecasts, multi-user camera sharing and related features as we offer them from time to time. Features may change as the product evolves; we will not materially reduce paid-plan functionality without at least 30 days' notice to active subscribers.
2. Account, eligibility, and your responsibilities
You must be at least 13 years old, or older where your country sets a higher age for using online services without a guardian's approval (15 in France, 16 in Germany), and able to enter into a binding contract under your local law; a minor needs a guardian's approval. You are responsible for keeping your password and any cameras you connect under your sole control. You must give us accurate account information and update it when it changes. You are responsible for everything that happens under your account.
3. Cameras and content you upload
You retain ownership of the images and metadata your cameras send us. You grant us the limited rights we need to operate the service, and the research licence set out at the end of this section: receiving, storing, classifying, processing for analytics, and displaying your content back to you and to people you explicitly share with. We are a data processor for that content; you are the controller. The terms of our processor relationship are set out in our Data Processing Agreement, which is incorporated into these terms by reference.
You confirm that you have the right to operate every camera you connect, that you respect the privacy rights of any people who may incidentally appear in your images, that you display required signage where local law demands it (for instance Finnish Tietosuojalaki §32 on cameras in semi-public spaces), and that you will not use the service to monitor people without a lawful basis.
You also grant us a non-exclusive, worldwide, royalty-free licence to include images from your cameras that qualify under section 4a of the Privacy Notice in an anonymised wildlife research dataset, and to license that dataset to research organisations for research purposes, including the training and evaluation of machine-learning models. The dataset never identifies you, your account, your camera or your land; images are stripped and positions coarsened as described there. You may ask us to exclude any camera at any time. For images already delivered in a dataset this licence survives deletion of the image and termination of your account, because the delivered copies can no longer be traced back to you.
4. Acceptable use
You agree not to:
- Upload content that is unlawful, infringes third-party rights, or is collected in violation of privacy or surveillance laws;
- Use the service to monitor identifiable individuals other than yourself and persons who have consented to that monitoring;
- Reverse-engineer, scrape, or bulk-extract images other than your own;
- Probe the service for vulnerabilities except under a written authorisation we issue (see section 13 on contact);
- Resell access to the service or transfer your account to a third party without our written consent;
- Send automated traffic that materially degrades the service for other users.
We may suspend or terminate accounts that violate this section, with notice when reasonably possible. We will give you a chance to export your data before deletion except in cases of serious abuse.
5. Subscription, billing, and trial
Paid subscriptions are billed per camera connected to your account, monthly or yearly in advance, at the prices shown on our website; paying yearly costs 20% less. Every new account starts with a free 30-day trial of up to 2 cameras on the Basic plan, with no payment details required. When the trial ends, your cameras stop receiving photos until you subscribe; everything already delivered stays viewable. Cameras can be added at any time and are charged pro rata for the rest of the current cycle (small amounts are added to your next invoice instead); a camera can be moved up to a larger plan at any time on the same basis. To move a camera to a smaller plan, remove it: the unused time is credited against your next invoice. We do not refund unused time. Prices are shown inclusive of any applicable value-added tax (VAT). Paddle.com Market Limited acts as our Merchant of Record and the seller of record for your purchase, and collects and remits VAT where required.
We use Paddle.com Market Limited (United Kingdom) as our Merchant of Record to process payments. Card data is held by Paddle; we never see or store full card numbers.
Right of withdrawal (consumers, EU/EEA): if you are a consumer resident in the EU/EEA, you have 14 days from the date your paid subscription starts to withdraw without giving any reason and receive a full refund. To exercise the right, email hello@otsovision.com within 14 days. Note that under Article 16(m) of the Consumer Rights Directive, the right of withdrawal expires once we have, with your explicit consent, begun supplying digital content within the 14-day period; we ask for that consent at checkout. After the withdrawal period ends, paid periods are non-refundable except where required by law.
You can cancel your subscription at any time from the Billing screen in the app or via the Paddle customer portal; removing your last camera cancels it too. Cancellation takes effect at the end of the current paid period, after which your cameras stop receiving photos; we do not pro-rate refunds for unused time, except where required by local consumer law.
6. Service availability and support
We aim for high availability but do not guarantee uninterrupted service. We perform maintenance, upgrades and incident response on a best-effort basis; we do not currently offer a contractual uptime SLA. Support is provided by email at hello@otsovision.com; we typically respond within two business days.
7. Intellectual property
The service, including its software, design, documentation and brand, is owned by us and protected by copyright and other intellectual-property laws. We grant you a non-exclusive, non-transferable, revocable licence to use the service for its intended purpose for as long as your account is active.
8. Disclaimer and limitation of liability
The service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim implied warranties of merchantability and fitness for a particular purpose, and we do not warrant that AI species detection, activity forecasts or any other inference will be accurate or complete. You must not rely on AI output for hunting decisions that require certainty (for example, age or sex of a quarry under hunting-licence rules).
To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of or relating to the service is limited to the fees you paid us in the twelve months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential or special damages, lost profits, lost data, or loss of goodwill. Nothing in these terms excludes or limits liability that cannot be excluded under applicable mandatory law (including liability for gross negligence or wilful misconduct, and liability to consumers under mandatory consumer-protection law).
9. Termination
You may close your account at any time from the Profile screen (export your data first if you want to keep it; deletion is immediate and irreversible under GDPR Article 17) or by emailing us. We may terminate or suspend accounts for material breach of these terms or applicable law, with reasonable notice except where immediate action is necessary (for example to stop ongoing abuse). On termination, we delete your data within 30 days, subject to backups that are deleted on rolling cycles, and to records we are required to retain by law (billing records: 6 years under Finnish Kirjanpitolaki).
If your trial ends or your subscription lapses without renewal, your cameras stop receiving photos, but your account is not closed: you and anyone you have shared with keep viewing everything already delivered. We remind you when this happens, after three months and again one month before deletion. Six months after the lapse we delete the photos on your account, except those already included in the anonymised research dataset (section 3); your account, camera settings and statistics remain, and subscribing again at any time resumes delivery.
Datasets already delivered to research organisations under section 3 are not withdrawn on termination.
10. Changes to these terms
We may update these terms to reflect changes to the service or applicable law. We will notify active subscribers by email at least 30 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms; if you do not accept them, you may cancel your subscription before they take effect and receive a pro-rata refund for the unused paid period.
11. Governing law and disputes
These terms are governed by the laws of Finland, without regard to conflict-of-laws principles. Disputes will be resolved by the District Court of Helsinki (Helsingin käräjäoikeus) as the court of first instance. Consumers in the EU/EEA retain the right to bring proceedings in their country of habitual residence and to invoke mandatory consumer-protection law of that country. 12. Miscellaneous
If any part of these terms is held unenforceable, the rest remains in force. We may assign these terms to a successor in connection with a business transfer, on at least 30 days' notice. No waiver of any provision is effective unless in writing. These terms, the Privacy Notice and the DPA constitute the entire agreement between you and us regarding the service.
